Blog > Who Pays Transfer Tax in Nevada
In Nevada, the buyer and the seller are jointly and severally liable for the real property transfer tax, according to Nevada Revised Statutes chapter 375. Each of you can be held to the full amount. The rate is $1.95 plus Clark County’s $0.60 per $500 of value.
Transfer tax rate for a Henderson home
The rate is where the cost comes from, and it has one catch worth knowing early: the tax counts every $500 of value, and a leftover fraction still counts as a full $500 block. The Nevada Department of Taxation (read 16 Oct 2026) sets the state rate at $1.95 for every $500 of the property’s value or any fraction thereof.
If your home is in Clark County, the county adds $0.60.
The county recorder in the county where the property sits collects the tax. It is collected when the transfer documents are recorded.
Who owes the tax: both buyer and seller
Both buyer and seller are liable for the whole tax, and the escrow holder is not. That is the plain reading of NRS 375.030 in Nevada Revised Statutes chapter 375 (read 16 Oct 2026). “Jointly and severally liable” is the legal name for that setup: each party can be held to the full amount.
For you as a seller, the point is practical. The statute names you as liable, so you should know how the tax is being handled on your sale.
Heads up: the sources we draw on do not say which party customarily pays. Check with your escrow officer.
Transfer tax exemptions in Nevada
Some transfers owe no tax at all. NRS 375.090 (Nevada Revised Statutes chapter 375, read 16 Oct 2026) exempts, among others, two kinds of transfer:
- A transfer of title between former spouses under a divorce decree.
- A transfer from one joint tenant or tenant in common to the remaining owners without consideration (meaning nothing is paid for it).
The statute exempts others too, and this page covers only these two. If your situation looks like an exemption, read the full list in chapter 375 or ask your escrow officer before you assume either way.
An ordinary sale of your home to a buyer is not one of these two. Plan for the tax in that case.
Questions people ask
How do I estimate the tax on my home?
Divide the property’s value by $500 and count any fraction as a full block. Multiply the number of blocks by each listed rate, the state’s $1.95 and Clark County’s $0.60, and add the results. Your escrow officer can confirm the exact amount for your sale.
Does the tax depend on the property’s value?
Yes. The Nevada Department of Taxation (read 16 Oct 2026) states the rate per $500 of the property’s value. The sources we draw on do not break down how value is determined for a given sale, so ask your escrow officer.
Where can I read the exemption rules myself?
Nevada Revised Statutes chapter 375 holds them, and NRS 375.090 is the exemption section. This page covers only two of the exempt transfers.
Who collects the transfer tax, and when?
It goes to the recorder of the county your home is in, at the moment the transfer documents are recorded.
